Excerpt from The Law Magazine, or Quarterly Review of Jurisprudence, 1843, Vol. 29 In the chapter on costs, the author contents himself with stating the grounds on which they are granted or refused, and the means by which they are recovered, &c., and omits all mention of their probable amount. As a writer on principles, he was correct in making this omission; but as a practical guide, he would have conferred a greater benefit on his countrymen, had be furnished them with some data by which they might collect the average expense of prosecuting with effect a writ of error or an appeal. A gentleman, on taking his seat in the House of Commons, was overheard not long since indulging in the following soliloquy: I began life a rich man; I have stood three contests, and am at length suc cessful. Well, my fortune is still sufficient to qualify me for a member, and, thank God, my opponent has not got a shirt to his back. If the costs of proceedings in Courts of last resort had been stated in the Treatise before us, the public might have learnt, ' what is known to the profession, that in this free and enlightened country, it is not at the hustings only that fortunes may be lost. Excerpt from The Law Magazine, Vol. 21: Or Quarterly Review of Jurisprudence, for February, 1839; And May, 1839 It is a general opinion amongst our readers that we have already devoted more space to Mr. Warren's lucubrations than they are worth, and as his complete misconception of the nature and exigencies of the profession and the impracticability of his peculiar plan of study - the two radical all-pervading errors of his work - have been satisfactorily exposed, it certainly seems useless to proceed with a systematic review. Our more immediate object, therefore, is to introduce the enlightened American whose work is named at the head of this article, and then afford the rising generation the benefit of sundry promised hints and suggestions of our own. The work Mr. Hoffman's most closely resembles is M. Dupin's edition of Camus, in which the course to be adopted by the legal aspirant is marked out, the various rights and duties of the practising advocate are explained, and the leading books on the codes or systems of almost every country in the world, known to possess a code or system, are enumerated. But there is this material difference - M. Dupin makes no pretension to a critical acquaintance with an immense majority of the authors named by him, and gives the student little or no aid whatever in making a selection from the mass. Excerpt from The Law Magazine, or Quarterly Review of Jurisprudence, Vol. 15: For February, 1836, and May, 1836 In the next place, although it is true that a small number of Judges may be more likely to agree on the generality of questions submitted to them than a larger number, yet it is no less true that whenever they could not so agree, their dif ference would be more inveterate, and, as it would soon be come generally known, would occasion much greater nucer tainty and dissatisfaction. If the Judges were retained always on the same circuits, different bodies of law and practice would be framed in difl'erent parts of the kingdom. If they changed their districts, each one, having his own method of proceeding in some points, would annually reverse the rulings of his predecessor throughout a great extent of country. But the first alternative would be almost impracticable on other grounds. The political bias of 9. Commissioner, becoming a matter of common notoriety, and made the subject of the exaggerations and mis-statements so eagerly circulated respect ing all topics connected with elections, would entirely deprive the public in his district of confidence in his decisions. Nor would the matter be much mended by their travelling different circuits in rotation, as each would bring to his new employ ment the character in public estimation which he had obtained upon his former one. The tendency of Mr. A.'s mind to wards a strict construction of the Act, the disposition of Mr. B. To relax it, Mr. O.'s high Conservative principles, and Mr. D.'a Whig partialities, would become matter of ordinary con versation, and any one who has attended our Courts of Revi sion will know how much this circumstance would tend to inflame the passions and resentments, the mistrust and sus picion, which are engendered in those scenes of political contest.
