Injunction against Strikes at the Suit of the State.?There have been comparatively few instances in which either the state or the national government has resorted to the injunction as a means of preventing strikes so extensive in character as seriously to inconvenience a large part of the public, yet the fact that there are potential perils to the public arising out of the wide-spread co-ordination of labor interests invests the subject of equitable jurisdiction to enjoin strikes with growing importance.1 In Kansas, the legislature had created the Court of Industrial Relations ard had invested it with power to summon before it persons involved in labor disputes arising in certain specified industries, which were characterized as being affected with a public interest, and to determine and regulate the matters in controversy. Included in this classification of industries was coal mining. The defendant Howat and others, as members of a District Board of United Mine Workers of America, were about to violate and defeat the act by calling a strike of miners in the region comprising the coal mining district of Kansas. The Attorney-General thereupon sought and obtained from the district court of the state an injunction against the calling of the strike. Is it not legally conceivable that if street railroad and elevated fares remain at five cents and private or municipal bus lines are placed in service that an increase in subway fares will yield a smaller gross revenue than under existing conditions? Has not the city the right to determine whether it will stand upon its contract, and if this right is taken away by legislative action, has not a private contract right been impaired?"
