Excerpt from The American Journal of International Law, 1914, Vol. 8 The principle of international law is, of course, not regarded as depend ent on the will of any particular state: some further authorization is necessary. This is well recognized by the United States in the fulfillment of its obligation with regard to hostile expeditions. The American courts, in so far as they are not bound by statute, apply the law derived from the practice of all nations and are not restricted to purely American authorities.' But in the absence of clear and definite rules developed by long custom in the world at large, we are compelled to resort to the evidence of the most extensive precedents. In one sense the practice of the United States is to be regarded as a source of the principle of international law. It is that most extensive practice wherein the best evidence of the law is likely to be found. Furthermore, since this is a country which has had much to do with expeditions, the consensus of international opinion is incomplete without large regard for the American attitude toward the subject. The principles with regard to the present subject have come to be recognized largely through their application by the. Excerpt from The American Journal of International Law, 1916, Vol. 10 If there are controlling reasons why the vessels' may not be sent in for adjudication, as unseaworthiness, the existence of infectious disease, or the lack of a prize crew, they may be appraised and sold; and if this can not be done they may be destroyed. The imminent danger of re capture would justify destruction if there was no doubt that the vessel was good prize. But in all such cases all the papers and other testimony should be sent to the prize court in order that a decree may be entered. As was the case with the Russian regulations, no distinction was made between enemy and neutral prizes. Whether it was intended to author ize the destruction of neutral merchantmen in any case may be doubted. Excerpt from The American Journal of International Law, 1908, Vol. 2 But we cannot content ourselves with a mere statement Of results, for the conference must rise or fall not by the amount accomplished, not by the number of conventions negotiated and signed, but by their value and importance. As the various conventions, declarations, reso lutions, and voeux of the conference have been incorporated in the Final Act and arranged in what seemed to the conference their order of importance, it appears advisable to discuss the various results of the conference in the order established by the Final Act. Perhaps a word of explanation is necessary as to the Final Act itself. It states the calling of the convention, enumerates the countries and their delegates taking part in the conference. But the Final Act is not a convention; it is rather a solemn statement of what was done, a summary or résumé of results indicated by the names and titles of the conventions, to be followed by the text in separate form.
