Excerpt from S. 39, Reauthorization of the Magnuson Fishery Conservation and Management Act: Hearing Before the Subcommittee on Oceans and Fisheries of the Committee on Commerce, Science, and Transportation, United States Senate, One Hundred Fourth Congress, First Session The Fisheries Management Councils need to be further encouraged to develop means of limiting access that are appropriate for the fisheries they manage. The methods of limiting access to fishery resources should not and, in fact, cannot be the same for every fishery. There are difficult questions to answer when considering how to limit access that will vary among the fisheries. Answers to questions like who deserves access and how will access be limited need to take into consideration the nature of the fishery, the historical and current participants, the diversity of participants in terms of gear type, ownership, and size, and the way in which new participants can gain access to the fishery, as well as the conservation of a healthy fish stock. Decisions about who gets to fish need to be made in a fair and equitable manner without discriminating against particular fishing groups or individual fishers. All fishing interests, from large corporate factory trawlers to small family-owned catcher boats and long-liners need to be included.
