Dans ce travail, nous étudions l'émergence de nouveaux territoires intermédiaires entre la commune et le département, les territoires de projet : pays et agglomérations. En mobilisant une documentation importante avec un souci de réflexion qui dépasse le seule approche juridique au profit d'une approche plus globale qui associée le droit, l'histoire, l'économie, la géographique et la sociologie, l'analyse montre que la consécration de ces territoires a connu des résistances fortes avant 1990. La première partie traite leur consécration hésitante. Nous montrons, à la lumière des expériences passées que, contrairement au autres Etats européens qui ont constitué des échelons intermédiaires fondés sur l'existence de communautés territoriales, la France a fait le choix de l'émiettement communal (chapitre 1). Ce préalable nous a permit d'expliquer non seulement les hésitations des réformes des années 1960-1970 à valoriser les pays et les agglomérations (chapitre 2), mais aussi le paradoxe des réformes des années 1982-1983 qui, tout en les revalorisant, éloignent toute idée d'instaurer un nouvel échelon intermédiaire (chapitre 3). La deuxième partie aborde le regain d'intérêt pour les territoires de projet, qui marque une rupture par rapport aux lectures antérieures. Tout d'abord, nous présentons leur institutionnalisation par la LOADDT de 1999 qui définit le cadre du projet commun de développement à l'échelle des pays et des agglomérations (chapitre 4). Ensuite, nous montrons leur structuration juridique (chapitre 5). Enfin, en théorisant les territoires de projet, nous soulignant leur rôle dans le processus de modernisation de l'État et de l'action publique territoriale (chapitre 6).
