Excerpt from Reports of Explorations and Surveys, to Ascertain the Most Practicable and Economical Route for a Railroad From the Mississippi River to the Pacific Ocean, Vol. 6: Made Under the Direction of the Secretary of War in 1854-5, According to Acts of Congress of March 3, 1853, May 31, 1854, and August 5, 1854 Sir: In Obedience to instructions from the War Department, I have the honor to submit the accompanying report of the exploration and survey in California and Oregon, conducted by Lieutenant R. S. Williamson, United States Topographical Engineers, in 1855. The prepara tion of the report has devolved upon me, in consequence Of the severe and protracted illness of Lieutenant Williamson; and it is due to myself to state that I have performed the duty with extreme reluctance, partly because it was not originally designed for me by the Department, and partly because it properly belongs to the officer by whose forethought and professional ability the expedition has been brought to a successful termination. Wishing to convey Lieutenant Williamson's ideas, as far as they are known to me, I have been guided by his recorded field notes, and by his Opinions expressed to me in conversation, in preparing the portion Of the report which relates to regions traversed by him. During a part Of the field work I was entrusted with a separate party, with instructions to prepare a written report Of the results Of my examinations. For any Opinion given in this portion Of the report he, of course, is not responsible. At the completion Of the survey for a railroad route from the Sacramento valley to the Columbia river, the season was so far advanced and the animals were in so jaded condition, that Lieutenant Williamson considered it impracticable to make any examination Of the Sierra Nevada until the ensuing spring. Before that time, orders were received from the War Department, directing him to return at once to Washington to prepare the maps, profiles, and reports Of the explora tion already made. Excerpt from Reports of Explorations and Surveys, to Ascertain the Most Practicable and Economical Route for a Railroad From the Mississippi River to the Pacific Ocean, Vol. 12: Made Under the Direction of the Secretary of War, in 1853-5, According to Acts of Congress of March 3, 1853, May 31, 1854, and August 5, 1854; Book II The introduction of the horse, about the beginning of this century, was a further inducement for burning, and doubtless also caused an increased settlement in the prairies by these people, hitherto accustomed to travel mostly by water, and to depend upon fishing for their subsistence. On some prairies near Vancouver and Nisqually, where this burning has been prevented for twenty years past, young spruces are found to be growing up rapidly, and Indians have told me that they can remember when some other prairies were much larger than at present. That they never were covered with forest is shown by the perfect smoothness of their surface; while in places very completely cleared of forests by fires is always found mounds and hollows, left by stumps, and an immediate growth of shrubs and trees follows, showing a tendency to return to forest, instead of to form prairies. Great changes must have occurred in the conformation and climate of this part of the coast since forests began to cover a surface once probably as bare as that of the Central Plains. The other assignments of error are based upon five bills of exceptions, none of which, it is insisted by the plaintiff, are properly parts of the record. In the view we take of the case it is unnecessary to consider these objections, except so far as they-apply to bill of exceptions numbered 5. The verdict of the jury was rendered at the December term, 1907, of the court. At that term the order of the court shows that a motion was made to set aside the verdict, and time taken until the next term by the court for its decision. At the next term (March, 1908) the order of the court shows that it overruled the motion to set aside the verdict, entered a final judgment. and granted leave to the defendant "to tender its bill of exceptions to the judge of this court in vacation within 30 days after the end of this term, which bill of exceptions, when signed, shall be a part of the record in this cause." The bill of exceptions No. 5, which is claimed was signed by the judge pursuant to that order, contains the following statement: "Be it remembered that on the trial of this case on the day of December, 1907, the plaintiff, in order to maintain the issue on his part, introduced the following evidence: (Here insert it.) And the defendant, to maintain the issue on his part, introduced the following evidence: (Here insert it)--all of which evidence, both for the plaintiff and the defendant, is found in a typewritten booklet now...
