Excerpt from Penal Code of State of Idaho, 1901 The evidence of insanity must out weigh and overcome the presumption of sanity. And the evidence in favor of sanity, in some appreciable degree. State v. Lewis, 20 Nev. 33. 22 Pac. 24l. 39 L. R. A. 740. The legal presumption is in favor of sanity, and one who does not deny the commission of the crim inal act. But pleads insanity as an ex cuse. Takes the burden of proof. And if he fails to produce evidence to change the presumption raised 'against him by the fact of the killing.
