La entrada en vigor de la Ley 31/1995 de 8 de noviembre, por la que se aprueba la Ley de Prevención de Riesgos Laborales (LPRL) aportó una nueva concepción de la Seguridad y Salud en el puesto de trabajo. Su aplicación supone la implantación de una cultura de prevención en todos los niveles de la empresa, tendente a evaluar y minimizar los riesgos que para la salud del trabajador pudiera ocasionar la actividad laboral. La Ley 54/2003, de 12 de diciembre, reforma el marco normativo de la prevención de riesgos laborales y refuerza la obligación de integrar la prevención de riesgos en el sistema general de gestión de la empresa, tanto en el conjunto de sus actividades, como en todos los niveles jerárquicos de la misma, a través de la implantación y aplicación de un plan de prevención de riesgos laborales (art. 16 LPRL), considerándolo como el primer documento a elaborar por el empresario , en base al cual se articulará toda la acción preventiva (artículo 23 LPRL). Por ello, en aplicación de los artículos 16 y concordantes de la Ley de Prevención de Riesgos Laborales, la empresa, mediante la aprobación del presente documento, ha de dar carta de naturaleza a su Plan de Prevención de Riesgos Laborales, basado en promover el bienestar físico, mental y social de los trabajadores de la empresa, para garantizar la seguridad y la salud de las personas en el trabajo, así como la seguridad de los bienes y del medio ambiente. He aquí un ejemplo concreto.
