Excerpt: ...we are satisfied that the fundamental principles of government declared by our bill of rights clearly and unequivocally prohibit legislation of the character of that involved in this case. Corporations--Liability Of Stockholders For Wages.--Section 41jlc8 of volume 3, Howell's Annotated Statutes of Michigan, provides that stockholders of manufacturing corporations "shall be individually liable for all labor performed for such corporations, which said liability may be enforced against any stockholder by action founded on this statute, at any time after an execution shall be returned unsatisfied in whole or in part against the corporation," etc. Under this statute suit was brought before a justice of the peace byRalph Kamp against Peter Wintermute, a stockholder in the Cheesman and Kelly Manufacturing Company, to recover for personal work and labor performed by Kamp for the company before Wintermute became a stockholder therein. The justice gave judgment for Kamp, and the cause was removed to the circuit court of Muskegon County by 3687--No. 4 7 writ of certiorari and there the judgment of the justice was reversed. The case was then carried to the supreme court of Michigan, which affirmed the judgment of the circuit court, holding that the statute in question does not make a stockholder liable for labor performed before he became a stockholder. The opinion of the supreme court was delivered by Judge Long, and is published in volume 65 of the Northwestern Keporter, pago 570. In the course of the opinion Judge Long said: It is conceded in this court that the defendant was not a stockholder in the corporation at the time the labor was performed; but, as shown on the trial before the justice, he was a stockholder at the time suit was...

SEO. 5. If the employer, or the insurance company carrying such risk, or commissioner of insurance. as the case may be, and the injured employee reach an agreement in regard to compensation under this act, a memorandum of such agreement shall be filed with the industrial accident board, and, if approved by it, shall be deemed final and binding upon the parties thereto. Such agreements shall be approved by said board only when the terms conform to the provisions of this act. SEC. 6. If the employer, or the insurance company carrying such risk, or the commissioner of insurance, as the case may be, and the employee fail to reach an agreement in regard to compensation under this act. either party may notify the industrial accident board, who shall thereupon call for the formation of a committee of arbitration. The committee of arbitration shall consist of three members, one of whom shall be a member of the industrial accident board, and shall act as chairman. The other two members shall be named respectively by the two parties. SEC. 7. It shall be the duty of the industrial accident board, upon notification that the parties have failed to reach an agreement, to request both parties to appoint their respective representatives on the committee of arbitration. The board shall designate one of its members to act as chairman, and, if either party does not appoint its member on this committee within seven days after notification as above provided, the board or any member thereof shall fill the vacancy and notify the parties to that effect. Inflammable structures may not be built over these openings and no breaker may be built within 200 feet of them. Minute provision is mrde for ventilation, both as to the method of supplying the air and the quantity to be supplied, for the daily examination of dangerous places, for safety appliances in entering and leaving the mines, and for the inspection and care of machinery, besides some fifty-eight specific rules for the guidance of miners and employers, the value of which one unskilled in mining operations can not judge. To see that the provisions of the law are complied with eight inspectors are provided for. They are appointed by the governor on the recommendation of boards of examiners, of which there are three for the anthracite region. These boards are composed of three reputable miners in active practice and two reputable mining engineers, all appointed by the judges of certain county courts. The inspectors are charged with the further duty of keeping informed of the condition of the mines of their respective districts as to ventilation, machinery, drainage, method of lighting, use of lights, and so on, to investigate all accidents and report thereon, and to make all needed suggestions for providing for the health and safety of the employees. 1453--No. 13 6 Xo occasional inspection or regulations on paper can, however, take the place of intelligent supervision of the mines. Excerpt from Bulletin of the Bureau of Labor, 1907, Vol. 15 Some idea of the high prices of 1906 can be gained when it is seen that the average prices of 17 of the 30 articles Were higher in 1906 than in any other year of the seventeen-year period 1890 to 1906. Compared with prices in 1896, the year of lowest prices during the period, the price of every article, except coffee and prunes, was higher in 1906 than in 1896, and in the case of 12 of the 30 articles it was more than 25 per cent above the level of 1896. The increases in the price of some of the more important articles over the 1896 prices were as follows: Bacon, per cent; potatoes, per cent; fresh pork, per cent; lard, per cent, and chickens, per cent. The average price in 1906 for each of the 30 articles separately and as a whole is compared with the average price during each of the years from 1890 to 1905 in the following table which shows the per cent of increase or decrease. PRIVATE EMPLOYMENT OFFICES. There can be little doubt that the most important agencies for the distribution of labor in Massachusetts and in Boston are the private employment agencies. There are 96 of these agencies in Boston, and it is estimated that there are from 250 to 300 of them in the State. The State law provides that such agencies shall pay a license fee of not less than $2; that fees shall not be accepted unless employment is furnished; and that in case of discharge within 10 days without cause, five-sixths of the fee shall be refunded. False advertising is prohibited, and a fine of $50 to $200 is fixed for sending any woman to enter a house of ill fame. Three cities, Cambridge, Lowell, and Boston, have regulations supplementing the State laws. In all cities except Boston employment ofiices are licensed by the mayor and board of aldermen, and the duty of enforcing the laws concerning them rests upon these oflicials. In Boston the licenses are issued by a license board consisting of three members, appointed by the governor. The licensing and control of employment oflices is only one of the duties of this board, which also issues liquor licenses, victualer's licenses, and other licenses. The rules issued by this board divide employment ofiices into two classes, Class I and Class II.
