In this state lasting and valuable improvements have frequently been made by persons in possession where the title was in another, and where the per son making the improvements believed the land to be his own. Where this is the case, the party who receives the benefit and ad vantage of these improvements, upon every principle of equity, ought to compensate him who made them for his labor. From Cuyahoga. The only evidence od'sted by the plaintiffs, was a promissory note of the defendants, dated Oct. 1st, 1834, to the plain tifl's or order, for $336 70, payable on the first of January then next. The defendants then ofl'ercd to prove that the note was executed and delivered for the purpose of taking up a note previously given, for some interest in a patent right.
