ORIGIN OF THE PROJECT In Spring of 1968 a research project concerning the scholastic philosophy in the Iberian Colonies of America was submitted to the Institute of Latin American Studies in the University of Texas by Dr. Ignacio Angelelli, of the Department of Philosophy of the same University. I should like to quote some relevant passages from the proposal by way of historical back ground. In the last decade, leading philosophical historiography has become more and more interested in the "minor" figures and the "traditional" schools which flourished between 1500 and 1800. Historians of philosophy are interested not only in men like Descartes and Kant, but also in the less brilliant and more "conservative" authors. It is also interesting to note in this regard that the late Professor P. Wilpert (Cologne), editor of the new edition of Ueberweg, intended to divide the section on the Neuzeit into two volumes, one for the major figures and the other for the exponents of the various forms of scholasticism of the period 1500-1800. One of these conservative philosophical movements is what has been called the seconda scolastica, which developed in Catholic countries and particularly in Spain and Portugal. Naturally, this "traditional" thought in Europe after 1500 was bound to have an impact on the Spanish and Portuguese Colonies. Indeed, the amount of scholastic philosophy taught in the American Colonies between 1530 and 1800 is impressive. This fact has not yet been acknowledged by international historiography.

Over the past few decades, a growing number of studies have highlighted the importance of the ‘School of Salamanca’ for the emergence of colonial normative regimes and the formation of a language of normativity on a global scale. According to this influential account, American and Asian actors usually appear as passive recipients of normative knowledge produced in Europe. This book proposes a different perspective and shows, through a knowledge historical approach and several case studies, that the School of Salamanca has to be considered both an epistemic community and a community of practice that cannot be fixed to any individual place. Although Descartes' natural philosophy marked an advance in the development of modern science, many critics over the years, such as Newton, have rejected his particular `relational' theory of space and motion. Nevertheless, it is also true that most historians and philosophers have not sufficiently investigated the viability of the Cartesian theory. This book explores, consequently, the success of the arguments against Descartes' theory of space and motion by determining if it is possible to formulate a version that can eliminate its alleged problems. In essence, this book comprises the first sustained attempt to construct a consistent `Cartesian' spacetime theory: that is, a theory of space and time that consistently incorporates Descartes' various physical and metaphysical concepts. "Most modern philosophers, by contrast, consider these two orders to be entirely separate. Here Luis Cortest shows how traditional natural law (the form Thomas Aquinas developed from classical and medieval sources) was transformed by thinkers like John Locke and Kant into a doctrine compatible with early modern and modern notions of nature and morality. In early modern Europe one of the first of the great debates about moral philosophy took place in sixteenth-century Spain, as a philosophical dispute concerning the humanity of the Native Americans. This foreshadowed debates in later centuries, which the author reevaluates in light of these earlier sources. The book also includes a close examination of the recent work of scholars like John Finnis and Brian Tierney, who argue that traditional natural law theorists were defenders of a doctrine of positive rights.
