Pother, Governor of the State of Rhode Island To His Excellency Aram J. Pothier, Governor of the State of Rhode Island. Sir: - Complying with the provisions of Section 9 of Chapter 795 of the Public Laws of Rhode Island, the Public Utilities Commission presents its second annual report. Recommendations. Inspectors. The necessity of suitable legislation providing for the employment of inspectors qualified to properly supervise and inspect the several utilities is again urged. The Commission has engaged an engineer competent to supervise the manufacture of gas, but an inspector for steam railroads and one for street railways is necessary in order that the best results possible may be obtained. Reports. In its last report the Commission recommended an amendment to the law which would require every public utility to keep and render to the Commission in the manner and form by it prescribed, uniform accounts of all business transacted. This is made necessary by the apparently unintentional repeal of Sections one to nine, inclusive, of Chapter 215 of the General Laws, Section eight of which required annual returns to be made to the railroad commissioner. San Souci, Governor of the State of Rhode Island To His Excellency Emery J. San Souci, Governor of the State of Rhode Island. Sir: - Complying with the provisions of Section 9 of Chapter 795 of the Public Laws of Rhode Island, the Public Utilities Commission presents its tenth annual report. Complaints. One formal complaint was filed against a utility during the year 1921, namely, Qualified Electors of Westerly, R. I., Horace E. Burdick, Treasurer Watch Hill Fire District, et als, vs. Westerly Light and Power Company. This complaint was brought by the qualified electors through a vote of the Watch Hill Fire District against the utility and set forth that the charge for electricity to the Summer residents of that district is exorbitant and unwarranted, etc. A Notice of Investigation was issued and upon motion of both the petitioners and respondents, who desired to confer among themselves, the matter was postponed, pending the result of the negotiations between themselves, the whole matter to be reviewed later by the Commission for its consideration. Complaints Pending. Town Councils of the Towns of Bristol and Warren vs. Bristol and Warren Water Works. The same course was followed as outlined above. City of Newport, Board of Aldermen vs. Newport Gas Light Company. The Commission is waiting for petitioners to arrange for continuance of hearings. In the cases against the Providence Gas Company public hearings were held and citizens examined under oath and an exhaustive inquiry by the Commission has been made. Livingston Beeckman Governor of the State of Rhode Island To His Excellency R.Livingston Beeckman, Governor of the Slate of Rhode Island. Sir: - Complying with the provisions of Section 9 of Chapter 795 of the Public Laws of Rhode Island, the Public Utilities Commission presents its sixth annual report. Recommendations. The Commission each year has suggested certain amendments to the Public Utilities Act in order that the public might be assured of the benefits which the Act as originally drawn contemplated, and these amendments are again recommended. There now has been ample opportunity for the Commission to ascertain that, under the present law, any public utility can establish rates and practices which will become effective even while steps are being taken to determine their reasonableness. This is particularly true as to rates as the law provides, in effect, that any rate upon which thirty days notice is given to the public and the Commission becomes a lawful rate unless otherwise ordered by the Commission after a full hearing. The length of time required by the Act in which to issue notices of investigation and hearing and to hold such full hearing, particularly in rate making matters, is palpably too brief for a determination of the matter before the expiration of the thirty days and in consequence there arises the complex condition of a rate becoming effective while the question of its reasonableness is in process of adjudication.
